1.1 About ECOTRANSTOUR, is a tourism transportation and tour operator company duly registered and operating under the laws of the Republic of Costa Rica. We specialize in providing high-quality transportation services, guided tours, travel experiences, and coordination of tourism-related activities throughout Costa Rica.
1.2 Scope of Services
Through our website and booking platforms, ECOTRANSTOUR offers the following services:
- Private and shared transportation between tourist destinations within Costa Rica
- Reservations and bookings for tours, packages, and unique travel experiences
- Coordination and intermediation of accommodation services with partner hotels and lodges - - Organization of activities and experiences with third-party service providers
- Online booking and payment processing systems
- Customer support and travel assistance
1.3 Acceptance of Terms
By accessing, browsing, or using the ECOTRANSTOUR website (), mobile applications, or any of our digital platforms, and by making a reservation or purchasing any service, you (the "User/ Customer") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ().
If you do not agree with any part of these Terms, you must not use our Platform or services. Your continued use of our services constitutes ongoing acceptance of these Terms and any subsequent modifications.
1.4 Legal Capacity
By using our services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into binding contracts under the applicable laws of your jurisdiction. If you are booking on behalf of other passengers, you confirm that you have obtained their consent and that they agree to be bound by these Terms.

2. RESERVATIONS AND PAYMENTS
2.1 Booking Process
Reservations can be made through our Platform by selecting your desired service, date, and completing the online booking form. All bookings are subject to availability and confirmation by ECOTRANSTOUR. A reservation is considered confirmed only when you receive an official confirmation email from ECOTRANSTOUR containing your booking and service details.
2.2 Accuracy of Information
You are responsible for ensuring that all information provided during the booking process is accurate, complete, and up-to-date, including but not limited to: passenger names, contact details, pick-up locations, special requirements, dietary restrictions, and any medical conditions relevant to the service. ECOTRANSTOUR is not liable for issues arising from incorrect or incomplete information provided by the User.
2.3 Payment Methods
We accept payment through the following methods:
- Major credit cards (Visa, Mastercard, American Express)
- Debit cards
- PayPal
- Bank transfers (for advance bookings, subject to confirmation)
- Cash payments (only for specific services and upon prior arrangement)
2.4 Pricing and Currency
All prices displayed on our Platform are quoted in United States Dollars (USD) unless otherwise specified. Prices include applicable taxes unless explicitly stated otherwise. ECOTRANSTOUR reserves the right to modify prices at any time; however, confirmed bookings will honor the price agreed upon at the time of reservation.
2.5 Payment Terms
Full payment or a deposit (as specified for each service) is required at the time of booking to secure your reservation. For certain services, packages, or group bookings, a deposit may be required with the balance due prior to the service date. Specific payment schedules will be communicated during the booking process.
2.6 Confirmation and Electronic Receipts
Upon successful payment, you will receive an electronic confirmation via email containing your booking details, receipt, and any relevant instructions. Please review this information carefully and contact us immediately if any discrepancies are identified. You may be required to present this confirmation (printed or digital) at the time of service.
2.7 Price Adjustments
In the event of significant increases in transportation costs, fuel prices, taxes, exchange rate fluctuations, or other factors beyond our control, ECOTRANSTOUR reserves the right to adjust prices for unconfirmed bookings. Confirmed and paid reservations will not be subject to price increases except in extraordinary circumstances, in which case you will be notified and given the option to cancel with a refund.

3. CANCELLATIONS, MODIFICATIONS, AND REFUNDS
3.1 Cancellation by the User
Cancellations must be submitted via email to our customer service department. The following cancellation policies apply unless otherwise specified for particular services:
- More than 72 hours before the service: Full refund less a 10% administrative fee
- Between 48 and 72 hours before the service: Refund of 90% of the total amount paid (less a
10% administrative fee)
- Less than 24 hours before the service or no-show: No refund
Specific tours, packages, or promotional rates may have different cancellation terms, which will be clearly communicated at the time of booking and specified in your confirmation email.
3.2 Modifications and Changes
Requests to modify confirmed reservations (including date changes, passenger changes, or service adjustments) must be submitted at least 48 hours before the scheduled service and are subject to availability. Modification requests may incur administrative fees and potential price differences. ECOTRANSTOUR will make reasonable efforts to accommodate modification requests but cannot guarantee availability.
3.3 Cancellation by ECOTRANSTOUR, reserves the right to cancel or reschedule services due to circumstances including but not limited to:
- Insufficient number of participants (for shared or group services)
- Adverse weather conditions or natural disasters
- Mechanical failures or vehicle unavailability
- Government restrictions, public health emergencies, or force majeure events - Safety concerns or operational constraints
In the event ECOTRANSTOUR cancels a service, you will be offered the following options:
1. Full refund of all amounts paid
2. Credit toward alternative dates or services
3. Alternative comparable service (subject to availability)
3.4 Weather and Force Majeure
Costa Rica's tropical climate can result in unpredictable weather conditions. While we monitor forecasts closely, certain activities may be affected by rain, wind, or other weather factors. In cases where weather conditions make services unsafe or impossible to perform, ECOTRANSTOUR will assess the situation and may offer modified services, rescheduling, or refunds at our discretion.
Force majeure events (including but not limited to natural disasters, earthquakes, volcanic eruptions, pandemics, civil unrest, acts of terrorism, or government-imposed restrictions) may result in service cancellations without liability to ECOTRANSTOUR beyond refunding amounts paid for unperformed services.
3.5 Refund Processing
Approved refunds will be processed within 10-15 business days. Bank or credit card processing times may vary and are beyond our control. Administrative fees and third-party processing charges are non-refundable.
3.6 No-Show Policy
Failure to appear at the designated pick-up location or starting point at the scheduled time without prior notice will be considered a no-show and will result in forfeiture of the entire payment with no refund.

4. RESPONSIBILITIES OF ECOTRANSTOUR
4.1 Service Quality and Safety
ECOTRANSTOUR is committed to providing safe, reliable, and high-quality tourism services. We maintain our vehicles in proper working condition, employ qualified and experienced drivers and guides, and comply with all applicable safety regulations and tourism standards established by Costa Rican authorities, including the Instituto Costarricense de Turismo (ICT).
4.2 Compliance with Laws
All our operations comply with Costa Rican legislation, including but not limited to:
- Transportation and traffic regulations (Ley de Tránsito por Vías Públicas Terrestres)
- Tourism activity regulations (Ley de Incentivos para el Desarrollo Turístico)
- Consumer protection laws (Ley de Promoción de la Competencia y Defensa Efectiva del Consumidor)
- Environmental protection regulations
- Labor and employment standards
4.3 Licensed Operations
ECOTRANSTOUR maintains all necessary permits, licenses, and insurance required to operate as a tourism transportation and tour operator in Costa Rica. Our vehicles carry the mandatory insurance coverage including public liability and passenger insurance.
4.4 Limitations of Liability
While we take all reasonable precautions, ECOTRANSTOUR’ liability is limited as follows:
a) Maximum Liability: Our total liability for any claim arising from our services shall not exceed the total amount paid by the User for the specific service in question.
b) Excluded Damages: We are not liable for indirect, incidental, consequential, punitive, or special damages, including but not limited to lost profits, lost opportunities, emotional distress, or other intangible losses.
c) Personal Injury: ECOTRANSTOUR maintains insurance coverage for passenger injuries occurring during our direct services. Claims must be reported immediately and supported by appropriate documentation. Our liability is limited to the extent of our insurance coverage.
d) Personal Belongings: Users are responsible for their personal belongings at all times. ECOTRANSTOUR is not liable for lost, stolen, or damaged personal items unless such loss results from our gross negligence or willful misconduct.
e) Inherent Risks: Tourism activities, particularly adventure and nature-based activities, carry inherent risks. By participating, you acknowledge and assume these risks. ECOTRANSTOUR is not liable for injuries or incidents resulting from your failure to follow safety instructions or from risks inherent to the activity itself.
4.5 Delays and Schedule Changes
While we strive for punctuality, ECOTRANSTOUR is not liable for delays caused by traffic conditions, weather, road closures, accidents, or other circumstances beyond our reasonable control. We are not responsible for missed connections, flights, or other arrangements resulting from such delays.
4.6 Service Descriptions
We make every effort to accurately describe our services on our Platform. However, photographs, descriptions, and itineraries are for illustrative purposes and may vary slightly from actual experiences. Minor variations do not constitute breach of contract or grounds for compensation.

5. RESPONSIBILITIES OF THE USER
5.1 Accurate Information
You must provide truthful, accurate, and complete information when making reservations, including identification documents, contact details, and any special requirements or medical conditions that may affect your ability to safely participate in services.
5.2 Timely Arrival
You are responsible for arriving at designated pick-up locations or meeting points at the specified time. We recommend arriving at least 10 minutes early. Late arrivals may result in missed services without refund, as delays may affect other passengers or scheduled activities.
5.3 Valid Documentation
You must carry valid identification documents and any required travel documentation (passports, visas, permits) throughout the service. International travelers are responsible for understanding and complying with Costa Rica's entry requirements. ECOTRANSTOUR is not responsible if you are denied entry or unable to participate due to documentation issues.
5.4 Health and Physical Fitness
You are responsible for assessing your physical fitness and health suitability for activities. Certain tours involve physical exertion, altitude changes, exposure to elements, or other demands. You must inform us of any medical conditions, disabilities, allergies, dietary restrictions, or special needs that may require accommodation or that could affect your safe participation.
Pregnant women, individuals with heart conditions, mobility limitations, or other health concerns should consult medical professionals before participating in adventure activities.
5.5 Safety Compliance
You must follow all safety instructions provided by drivers, guides, and ECOTRANSTOUR staff. This includes but is not limited to:
- Wearing provided safety equipment (seat belts, helmets, life jackets, etc.)
- Following designated paths and staying with the group
- Respecting wildlife and maintaining safe distances
- Abstaining from drugs or alcohol during services
- Following COVID-19 or other health protocols if applicable
Failure to comply with safety instructions may result in removal from the service without refund and potential liability for damages caused.
5.6 Appropriate Conduct
Users are expected to behave respectfully and appropriately at all times. Prohibited conduct includes but is not limited to:
- Harassment, discrimination, or abusive behavior toward staff, guides, other passengers, or local communities
- Damage to vehicles, equipment, or property
- Illegal activities or possession of prohibited substances
- Disturbing wildlife or violating environmental regulations
- Creating safety hazards or disturbances
ECOTRANSTOUR reserves the right to remove any User engaging in inappropriate conduct without refund and may report illegal activities to authorities.
5.7 Environmental Responsibility
Costa Rica is renowned for its biodiversity and environmental conservation. You agree to: - Respect natural habitats and wildlife
- Follow "Leave No Trace" principles
- Dispose of waste properly
- Follow park rules and protected area regulations
- Avoid touching, feeding, or disturbing wildlife
- Support sustainable tourism practices
5.8 Minors
Children under 18 must be accompanied by a parent or legal guardian. The accompanying adult is responsible for the minor's behavior, safety, and compliance with these Terms. Age restrictions may apply to certain activities.
5.9 Assumption of Risk
By participating in our services, particularly adventure and outdoor activities, you acknowledge that such activities involve inherent risks including but not limited to personal injury, illness, property damage, or in extreme cases, death. You voluntarily assume all such risks and agree to participate at your own risk.

6. THIRD-PARTY SERVICES
6.1 Role as Intermediary
ECOTRANSTOUR acts as an intermediary for certain services including but not limited to: - Hotel and accommodation bookings
- Restaurant reservations
- Activities and experiences operated by third-party providers
- Entrance fees to national parks, museums, or attractions
- Equipment rentals provided by external vendors
6.2 Third-Party Terms
When we facilitate bookings with third-party providers, you may be subject to additional terms and conditions imposed by those providers. You are responsible for reviewing and complying with such third-party terms. The contractual relationship for these services is directly between you and the third-party provider.
6.3 Limited Liability for Third-Party Services
ECOTRANSTOUR exercises reasonable care in selecting reputable partners and service providers. However, we do not control third-party operations and are not liable for:
- Quality, safety, or performance of third-party services
- Cancellations, delays, or modifications by third-party providers
- Injuries, losses, or damages occurring during third-party services
- Disputes between you and third-party providers
- Refund policies or financial issues with third-party providers
While we will make reasonable efforts to assist with issues involving third-party services, ultimate responsibility lies with the service provider.
6.4 Partner Standards
We select partners based on quality and reputation standards. However, ECOTRANSTOUR does not guarantee that third-party services will meet your expectations or specific requirements. User reviews and ratings (when available) are provided as guidance but do not constitute warranties or guarantees.
6.5 Direct Communication
For issues specifically related to third-party services, you may need to communicate directly with the provider. ECOTRANSTOUR will provide contact information and reasonable assistance in facilitating such communication.

7. TRAVEL INSURANCE AND HEALTH
7.1 Travel Insurance Recommendation
ECOTRANSTOUR strongly recommends that all Users obtain comprehensive travel insurance covering:
- Medical expenses and emergency evacuation
- Trip cancellation and interruption
- Lost or delayed baggage
- Personal liability
- Adventure activities coverage (if participating in such activities)
While not mandatory, travel insurance provides important protection against unforeseen circumstances. ECOTRANSTOUR is not responsible for costs or losses that would have been covered by adequate travel insurance.
7.2 Insurance Verification
For certain high-risk activities, we may require proof of appropriate insurance coverage. You may be denied participation if adequate coverage cannot be verified.
7.3 Medical Fitness and Pre-existing Conditions
You are responsible for ensuring you are medically fit to participate in booked activities. If you have pre-existing medical conditions, you must:
- Consult your physician before traveling
- Ensure your condition is adequately managed
- Bring necessary medications in sufficient quantities
- Inform ECOTRANSTOUR and guides of any conditions that may require assistance or accommodation
7.4 Vaccination and Health Requirements
It is your responsibility to obtain information about and comply with any vaccination requirements, health certifications, or medical recommendations for travel to Costa Rica. Consult health authorities or travel medicine specialists regarding recommended vaccinations (such as those for Hepatitis A, Typhoid, or Yellow Fever depending on your travel history).
7.5 Medical Assistance
In the event of medical emergency during services, ECOTRANSTOUR will provide reasonable assistance in accessing local medical facilities. However, all medical costs, ambulance fees, hospital charges, and related expenses are the sole responsibility of the User or their insurance provider.
7.6 Limitation of Medical Liability
ECOTRANSTOUR staff and guides are not medical professionals (unless specifically indicated). Any first aid or medical assistance provided is done in good faith but does not create medical liability. We are not responsible for medical outcomes, pre-existing conditions, or health issues arising during travel.
7.7 COVID-19 and Communicable Diseases
Users must comply with any health protocols related to COVID-19 or other communicable diseases, including:
- Testing requirements if mandated
- Vaccination requirements if applicable
- Use of masks or protective equipment as required
- Health screenings and temperature checks
- Self-reporting of symptoms
- Quarantine requirements if exposed or symptomatic
ECOTRANSTOUR reserves the right to deny service to individuals who present symptoms of contagious illness or refuse to comply with health protocols.
7.8 Pregnancy
Pregnant travelers should consult their healthcare provider before participating in any tours or activities. Certain activities are not recommended for pregnant women. ECOTRANSTOUR is not liable for complications related to pregnancy, and pregnant travelers participate at their own risk.

8. DISPUTE RESOLUTION AND JURISDICTION
8.1 Governing Law
These Terms and any disputes arising from or related to the use of our Platform or services shall be governed by and construed in accordance with the laws of the Republic of Costa Rica, without regard to its conflict of law provisions.
8.2 Jurisdiction and Venue
You agree that any legal action, dispute, or claim arising out of or related to these Terms or our services shall be subject to the exclusive jurisdiction of the competent courts of San José, Costa Rica. You irrevocably consent to the jurisdiction of such courts and waive any objection to venue in these courts.
8.3 Amicable Resolution
Before initiating formal legal proceedings, the parties agree to attempt to resolve any dispute through good-faith negotiations. Either party may initiate this process by sending written notice to the other party describing the dispute and proposed resolution.
10.4 Mediation
If negotiations do not resolve the dispute within 30 days, the parties agree to participate in mediation before a neutral mediator agreed upon by both parties or appointed through a recognized mediation service in Costa Rica. The costs of mediation shall be shared equally unless otherwise agreed.
8.5 Consumer Protection Rights
Nothing in these Terms limits or waives your rights under Costa Rican consumer protection laws (Ley de Promoción de la Competencia y Defensa Efectiva del Consumidor). Consumers may file complaints with the Comisión Nacional del Consumidor or seek resolution through the corresponding consumer protection authorities.
8.6 Class Action Waiver
To the maximum extent permitted by law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive the right to participate in class action lawsuits against ECOTRANSTOUR.
8.7 Limitation Period
Any claim or cause of action arising from or related to these Terms or our services must be filed within one (1) year from the date the cause of action arose or from the completion of the service, whichever is later. Failure to file within this period constitutes a complete bar to such claim.
8.8 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

9. MODIFICATIONS TO TERMS
9.1 Right to Modify
ECOTRANSTOUR reserves the right to modify, amend, or update these Terms at any time without prior notice. Modifications may be necessary due to changes in law, business practices, service offerings, or operational requirements.
9.2 Notification of Changes
When significant changes are made to these Terms, we will update the "Last Updated" date at the top of this document. We may also notify registered users via email or through prominent notice on our Platform. However, it is your responsibility to review these Terms periodically.
9.3 Acceptance of Modifications
Your continued use of our Platform or services following any modification constitutes acceptance of the revised Terms. If you do not agree with the modifications, you must discontinue use of our services.
9.4 Effect on Existing Bookings
Modifications to these Terms generally apply to future bookings and uses of the Platform. Existing confirmed bookings will be governed by the Terms in effect at the time of booking unless changes are required by law or for safety reasons.

10. GENERAL PROVISIONS
12.1 Entire Agreement
These Terms, together with our Privacy Policy and any specific service terms communicated at the time of booking, constitute the entire agreement between you and ECOTRANSTOUR regarding the use of our Platform and services, superseding all prior agreements, communications, or understandings.
10.2 No Waiver
Failure by ECOTRANSTOUR to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it subsequently. Waiver of any provision must be in writing and signed by an authorized representative of ECOTRANSTOUR.
10.3 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. ECOTRANSTOUR may assign or transfer its rights and obligations to any affiliate, successor entity, or purchaser of substantially all of its business or assets without your consent.
10.4 Independent Contractors
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and ECOTRANSTOUR. Drivers, guides, and other service personnel are not your agents or employees.
10.5 Force Majeure
ECOTRANSTOUR shall not be liable for failure to perform its obligations under these Terms if such failure results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, pandemics, government actions, labor disputes, or failure of third-party services.
10.6 Language
These Terms are provided in English and Spanish. If translated into other languages, the Spanish version will prevail in the event of any inconsistency or dispute over interpretation.
10.7 Headings
Headings and section titles in these Terms are for convenience only and do not affect the interpretation of any provision.
10.8 Survival
Provisions that by their nature should survive termination of these Terms shall survive, including but not limited to provisions regarding intellectual property, liability limitations, indemnification, dispute resolution, and governing law.
